These Terms of Service ("Terms") govern your use of the CA Logistics website (www.calogistics.ca) and our freight transportation services. By using our website or services, you agree to be bound by these Terms.
1. Services
CA Logistics provides freight transportation, logistics management, and related services across Canada. All services are subject to availability and our acceptance of your shipment request. We reserve the right to decline any shipment that does not meet our operational or safety requirements.
2. Quotes and Pricing
- All quotes are estimates based on the information you provide and are valid for 7 calendar days unless otherwise stated.
- Final pricing may be adjusted if actual shipment specifications (weight, dimensions, cargo type) differ from the information provided at the time of the quote.
- All prices are in Canadian Dollars (CAD) and exclude applicable taxes unless explicitly stated otherwise.
3. Shipment Terms
- You are responsible for ensuring that all cargo is properly packaged, labeled, and ready for pickup at the scheduled time.
- You must provide accurate descriptions of cargo contents, including any hazardous, fragile, or temperature-sensitive materials.
- CA Logistics is not liable for damage resulting from inadequate packaging or inaccurate cargo descriptions provided by the shipper.
- Delivery times are estimates and not guaranteed unless an expedited or guaranteed delivery service has been purchased.
4. Liability and Insurance
- CA Logistics maintains cargo insurance in accordance with Canadian transportation regulations.
- Our maximum liability for loss or damage to cargo is limited to $2.00 CAD per pound of actual weight, unless additional insurance coverage has been purchased.
- Claims for loss or damage must be submitted in writing within 60 days of the delivery date (or expected delivery date for lost shipments).
- CA Logistics is not liable for delays or failures caused by force majeure events, including but not limited to severe weather, natural disasters, government actions, labour disputes, or pandemics.
5. Prohibited Cargo
The following items are prohibited from shipment without prior written authorization:
- Illegal substances or contraband
- Explosives, firearms, and ammunition
- Unpackaged hazardous materials without proper TDG documentation
- Live animals
- Currency, precious metals, or gems without declared value
6. Payment Terms
- Payment is due within 30 days of invoice date unless alternative terms have been agreed in writing.
- Late payments are subject to interest charges of 1.5% per month.
- CA Logistics reserves the right to withhold shipments or suspend services for accounts with outstanding balances.
7. Website Use
- The content on our website is for informational purposes only and does not constitute a binding offer.
- You agree not to use our website for any unlawful purpose or in violation of these Terms.
- All intellectual property on our website, including text, images, logos, and design, is owned by CA Logistics and may not be reproduced without written permission.
8. Privacy
Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Limitation of Liability
To the maximum extent permitted by law, CA Logistics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, regardless of the cause of action.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Continued use of our services after changes constitutes acceptance of the updated Terms.
